Privacy policy & PAIA manual

This policy explains how Exclusive Advisory Services (Pty) Ltd ("EAS", "we", "us") collects, uses and protects personal information under the Protection of Personal Information Act, 2013 ("POPIA"), and sets out our manual under the Promotion of Access to Information Act, 2000 ("PAIA").

Who we are

Exclusive Advisory Services (Pty) Ltd, Reg. No. 2022/763376/07, is an FSCA-licensed crypto asset service provider (FSP No. 53473) and is registered with the Financial Intelligence Centre (FIC). Our registered office is 3 Riebeek Street, 306 The Colosseum, Cape Town, Western Cape, 8001, with a further office in Dubai. RandCrypto (randcrypto.co.za) is EAS's own product and is covered by this policy.

Information we collect

Why we process it, and on what basis

We process personal information to respond to enquiries, to assess and provide advisory and liquidity services, to meet our obligations under FICA, the FSCA's requirements for crypto asset service providers, and other applicable law, and to maintain the security of our systems and communications. Our lawful bases are your consent in making an enquiry, the steps necessary to enter into and perform an engagement with you, and compliance with our legal obligations.

Sharing of information

We do not sell personal information. We may share it with: regulators, auditors and law enforcement where required by law; professional advisers bound by confidentiality; and service providers that support our operations, including WhatsApp/Meta as our messaging channel. Messages sent over WhatsApp are transmitted and processed by Meta in line with WhatsApp's own terms, which may involve processing outside South Africa. Given our Cape Town and Dubai offices, information may also be accessed by EAS personnel in the United Arab Emirates for the same purposes described in this policy.

Retention

We keep personal information only for as long as necessary for the purpose it was collected, or for the periods required by the Financial Intelligence Centre Act, 2001, and other applicable law, whichever is longer.

Security

We apply reasonable technical and organisational measures to protect personal information against loss, unauthorised access, alteration or disclosure, appropriate to a licensed financial services provider.

Your rights under POPIA

You may ask us to confirm what personal information we hold about you, to access it, to correct or update it, or to delete it, and you may object to certain processing or withdraw consent where processing relies on it. To exercise any of these rights, contact us using the details below.

We may update this policy from time to time. The date above shows when it was last revised.

PAIA manual

This section is our manual under section 51 of the Promotion of Access to Information Act, 2000.

Information Officer

The Information Officer for the purposes of PAIA is Exclusive Advisory Services (Pty) Ltd, contactable at the address and email above.

Records held

In the ordinary course of business, EAS holds records including company and regulatory records, client onboarding and due diligence records, transaction and correspondence records, and financial and accounting records. Some of these are available on request without a formal PAIA request (for example, our FSCA licence details and this policy); others, particularly client-specific or commercially sensitive records, are only available in line with PAIA and our confidentiality obligations to other clients.

How to request access to a record

Submit a request using the official PAIA request form (Form 2 under the PAIA Regulations) to the Information Officer at the contact details above. Please describe the record you are requesting with enough detail for us to locate it, and provide proof of identity. We will respond in line with the timeframes set out in PAIA.

Complaints to the Information Regulator

If you are not satisfied with our response, you may lodge a complaint with the Information Regulator (South Africa) at inforegulator.org.za.
